It obliged him to comply with the manual “[w]hile providing the best Chandigarh legal services“. But if the other court exercises the powers of the High Court the writ is refused (see Skinner v. But it is one of the surest indexes of a mature and developed jurisprudence not to make a fortress out of the dictionary; but to remember that statutes always have some purpose or object to accomplish, whose sympathetic and imaginative discovery is the surest guide law firm to their meaning.
A patent, by publicising an invention, makes it the patentee’s sole property for 20 years, so that the patentee’s immediate interests are in opposition to those of the rest of the world. Certiorari issues to Judges and officers of inferrior courts and’ jurisdictions, from the Queen’s Bench (now the Queen’s Bench Division) to certify or send proceedings so that the legality of the, proceedings may be examined. The Convention and Protocol place such exercises off limits in a way which, it seems to me, our law well understands and which sits comfortably with the wording and intent of section 125(1).
My view is that the quoted words are apt to have made the manual govern all aspects of Mr Smith’s operations in relation to Pimlico; in any event, however, the case proceeded before the tribunal on the basis that even after 2009 the manual remained as much a part of the contract as, on any view, it had previously been. If in spite of the abolition of ‘untouchability’ by constitutional provision included in Part III, any private shop-keeper, for instance, purports to enforce un- touchability against a Harijan citizen, the said citizen would be entitled to move this Court for a proper order under Art.
and the right to move this Court by an aggrieved citizen is not limited to his right to move only against the Legislature or the Executive. “Of course, it is true that the words used, even in their literal sense, are the primary, and ordinarily the most reliable, source of interpreting the meaning of any writing: be it a statute, a contract, or anything else. Similar is the position in regard to fundamental rights guaranteed by Articles 23 and 24.
That should furnish strong justification for saying that the Constitution did not contemplate the High ,Courts to be inferior courts so that their decisions would be liable to be quashed by writs issued by the Supreme Court which also had been given the power to issue the writs. It is in society’s longer-term interests that, by setting the two things in balance, genuine innovation should be protected and rewarded without stifling further invention.
Its relevant provisions are as follows: The inventor obtains a monopoly in return for disclosing the invention and dedicating it to the public for use after the monopoly has expired. Nor do I think that the cause of justice will in any manner be affected if a High Court is not made amenable to correction by this Court by the issue of the writ. The Earl of Russell was tried for bigamy by the King in Parliament before 160 peers and all the Judges of the High Court after removal thereof the case by certiorari (see The Trial of Earl Russell(1).
If an individual citizen contravenes the fundamental rights of another citizen, the aggrieved citizen can, according to Mr. This writ cannot be avoided by the Judge by not writing an order in the case before him. Certiorari lies only in respect of judicial, as distinguished from administrative, acts. Lord Davey’s approach, and any analogue of it, would reward opaque drafting as objectionably as the infringers’ defence in cases like Edison Phonograph seeks out opacity where, on a fair-minded reading, there is none.
(Halsbury, 3rd Edn, Vol XI, page 135, para 251). As illustrations supporting this best Chandigarh legal proposition, Mr. Setalvad referred us to the fundamental rights guaranteed by Articles 17, 23 and 24. The latter two will have been drafted for a purpose which, assuming it not to be illegal or contrary to public policy, the best Chandigarh law firms will do what it properly law firm can to uphold. No certiorari goes from one branch of the High Court to another nor to another superior court.
Article 17 abolishes ‘untouchability’. In my opinion, therefore, this Court has no power to issue a certiorari to a High Court. Elementary as it is, it is worth reminding oneself at the outset of the juridical basis on which patents are granted, sometimes called the “patent bargain”.
